UNDERSTANDING TRAVEL RISKS
Travel — domestic and international — involves inherent risks and uncertainties. By booking travel through Rick Oelkers/Ramblin with Rick LLC, you acknowledge that travel inherently involves risks including, but not limited to:
- Transportation delays, cancellations, and accidents
- Natural disasters, severe weather, and environmental hazards
- Political instability, civil unrest, terrorism, and acts of war
- Illness, disease, epidemics, and pandemics
- Medical emergencies in locations with limited healthcare access
- Crime, theft, and personal safety incidents
- Lost, stolen, or damaged luggage and personal belongings
- Acts or omissions of third-party suppliers
- Force majeure events beyond anyone’s control
WAIVER OF LIABILITY
1. Agent’s Role as Intermediary
I/We understand and acknowledge that Rick Oelkers/Ramblin with Rick LLC, is an independent travel agent affiliated with Cornerstone Collective, acting solely as an intermediary between clients and independent travel service providers, including but not limited to: airlines, cruise lines, hotels, resorts, car rental companies, tour operators, and transportation services (“Suppliers”).
2. No Control Over Suppliers
I/We acknowledge that Rick Oelkers/Ramblin with Rick LLC,has no ownership, control, or direct supervision over the Suppliers providing my/our travel services. Agent cannot guarantee the performance, quality, safety, or compliance of any Supplier.
3. Release of Liability
In consideration of the travel planning services provided by Rick Oelkers/Ramblin with Rick LLC, I/We, on behalf of myself/ourselves and all members of my/our traveling party, hereby release, waive, discharge, and covenant not to sue Rick Oelkers/Ramblin with Rick LLC, its owners, employees, independent contractors, successors, and assigns, and Cornerstone Collective, from any and all liability, claims, demands, causes of action, losses, damages, costs, and expenses of any kind arising out of or related to:
a) Supplier Conduct: Any act, error, omission, negligence, breach of contract, or misconduct by any Supplier, including transportation providers, hotels, cruise lines, and tour operators.
b) Travel Delays and Disruptions: Delays, cancellations, missed connections, overbookings, or itinerary changes by any Supplier.
c) Personal Injury and Property Damage: Any personal injury, illness, death, property damage, or loss occurring during travel, including during transportation, at accommodations, or during tours and activities.
d) Force Majeure: Natural disasters, acts of God, severe weather, acts of terrorism, war, civil unrest, pandemics, epidemics, government actions, or any other circumstances beyond Agent’s control.
e) Health and Medical Issues: Any illness, medical emergency, or health-related incident arising during travel, including issues resulting from local healthcare limitations.
f) Documentation Failures: Consequences resulting from my/our failure to maintain valid passports, visas, or required health documentation.
g) Insurance Decisions: Financial losses resulting from my/our decision to decline travel insurance.
h) Third-Party Activities: Any injury, damage, or loss arising from participation in optional activities, excursions, or tours arranged by third parties.
4. Assumption of Risk
I/We voluntarily and knowingly assume all risks associated with travel, including those risks described above and other inherent risks not specifically enumerated. I/We acknowledge that these risks cannot be eliminated and that I/we have the option to decline travel if I/we am/are not comfortable with the associated risks.
5. Indemnification
I/We agree to indemnify, defend, and hold harmless Rick Oelkers/Ramblin with Rick LLC, and Cornerstone Collective from any and all claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or resulting from my/our breach of this Agreement or any other agreement with Agent or Suppliers.
TRAVEL ADVISORIES
I/We acknowledge that I/we have been advised to review current U.S. Department of State travel advisories (travel.state.gov) and CDC travel health notices (wwwnc.cdc.gov/travel) for my/our destination(s) prior to departure. I/We are aware of the current travel advisory level for my/our destination(s):
